We are based in Madagascar. As we offer our tours to travellers in the European Union, we apply the EU General Data Protection Regulation (GDPR) as well as the Malagasy law no. 2014-038 on the protection of personal data.
2. Hosting and delivery of the website
This website is hosted by Amazon Web Services EMEA SARL, 38 Avenue John F. Kennedy, L-1855 Luxembourg (“AWS”). The files are stored on servers in Frankfurt (Germany) and delivered via the Amazon CloudFront network.
When you open the website, your browser automatically transmits technical data that is necessary to deliver the pages: IP address, date and time of the request, the requested page or file, browser type and operating system. This data is processed by AWS solely to display the website and to keep it secure (e.g. against attacks). We do not create access logs ourselves and do not combine this data with other data.
- Legal basis: Art. 6 (1) (f) GDPR (legitimate interest in a secure and functioning website).
- AWS acts as our processor. Data may also be processed in the USA; AWS is certified under the EU–US Data Privacy Framework and additionally uses the EU Standard Contractual Clauses.
3. Contacting us
By email
If you write to us by email – directly or via the form on this website – we process the information you provide (e.g. name, email address, travel dates, number of travellers, wishes) in order to answer your request and to prepare your trip.
The form does not send any data to a server: it only opens a pre-filled email in your own email program. Your message is only sent when you send it there yourself.
Our mailbox is hosted by ALL-INKL.COM – Neue Medien Münnich, Hauptstraße 68, 02742 Friedersdorf, Germany, on servers in Germany. ALL-INKL.COM processes the emails on our behalf as a processor (Art. 28 GDPR).
Via WhatsApp
If you contact us via WhatsApp, your messages are also processed by WhatsApp Ireland Ltd. (Meta). Please note WhatsApp’s own privacy policy. If you prefer, you can always reach us by email instead.
Legal basis and storage
- Legal basis: Art. 6 (1) (b) GDPR (pre-contractual measures and performance of the travel contract) and Art. 6 (1) (f) GDPR (answering general enquiries).
- We delete your messages when they are no longer needed for your request, unless statutory retention obligations (e.g. for bookings and invoices) apply.
4. Transfer of data to Madagascar
As our company is located in Madagascar, your enquiry is processed there. There is no adequacy decision of the EU Commission for Madagascar. The transfer is necessary to answer your enquiry and to organise your trip at your request (Art. 49 (1) (b) GDPR). We do not pass your data on to third parties unless this is necessary for your trip (e.g. reservations at accommodations or national parks) and you have been informed about it.
5. Your rights
You have the right to:
- access the personal data we hold about you (Art. 15 GDPR),
- have incorrect data corrected (Art. 16 GDPR),
- have your data deleted (Art. 17 GDPR) or its processing restricted (Art. 18 GDPR),
- receive your data in a portable format (Art. 20 GDPR),
- object to processing based on legitimate interest (Art. 21 GDPR),
- withdraw any consent you have given at any time with effect for the future.
To exercise your rights, simply write to hi@experiencemadagascartour.com.
You also have the right to lodge a complaint with a data protection supervisory authority, in particular in the EU member state of your residence. In Madagascar, the competent authority is the Commission Malagasy sur l’Informatique et des Libertés (CMIL).
6. Changes to this privacy policy
We will update this privacy policy if our website or our processing of personal data changes. The current version is always available on this page.
